Kazcade Terms of Service (End User License Agreement)

These Terms of Service ("Terms") are a legal agreement between you ("you", "player", or "user") and No Free Lunch ("we", "us", "our"), the publisher of the mobile game Kazcade (the "App" or "Game", bundle/application identifier com.nofreelunch.kazcade, website https://kazcade.app), distributed on the Apple App Store and Google Play.

By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

The App is also subject to the terms of the store you obtained it from — the Apple Media Services Terms and Conditions and Apple's Licensed Application End User License Agreement (LEULA) for the App Store, or the Google Play Terms of Service for Google Play. Where these Terms and the applicable store's terms conflict as to the App obtained through that store, the store's applicable terms control for that subject matter. See Section 13 (Store-specific terms).

1. Eligibility and age

The App is a general-audience game and is not directed to children under 13. You must be at least 13 years old (or the minimum age required in your country) to use the App. If you are a minor in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian, who is responsible for your use, including any in-app purchases. By using the App you represent that you meet these requirements.

2. License to use the App

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the App on device(s) you own or control — Apple-branded devices for the App Store version, or Android devices for the Google Play version — as permitted by the applicable store's rules, solely for your personal, non-commercial entertainment.

This is a license, not a sale. We and our licensors retain all right, title, and interest in and to the App, including all software, artwork, audio, text, gameplay, and other content ("Content"), and all intellectual-property rights therein. All rights not expressly granted are reserved.

3. Acceptable use

You agree that you will not, and will not attempt to:

• copy, modify, translate, or create derivative works of the App or its Content, except as permitted by law;
• reverse-engineer, decompile, or disassemble the App, or attempt to derive its source code, except to the limited extent applicable law expressly permits;
• rent, lease, lend, sell, redistribute, or sublicense the App;
• circumvent, disable, or interfere with security, monetization, ad-serving, or purchase mechanisms, or use cheats, bots, memory editors, automation, or exploits to manipulate scores, progress, currency, or entitlements;
• tap or generate clicks on advertisements in a fraudulent or automated manner, or otherwise generate invalid ad traffic;
• use the App for any unlawful purpose or in violation of these Terms, applicable law, or the applicable store's rules.

We may suspend or terminate your access (Section 11) for conduct that violates this Section.

4. Ads

The App is free and ad-supported. It displays advertising, including full-screen (interstitial) ads and optional, opt-in (rewarded) ads served by Google AdMob. Your interaction with ads and the data used to deliver them are described in the Privacy Policy and governed by Google's and Apple's policies and by your consent/tracking choices.

You may remove ads by subscribing to Kazcade Plus (Section 5). We do not control the specific ad creatives shown and are not responsible for third-party ad content or the websites or app-store pages ads may link to.

5. In-app purchases and subscriptions

The App offers optional in-app purchases, including gem and coin bundles, the Kazcade Plus auto-renewable subscription, a one-time new-player Starter Pack, and undo packs. Prices shown in the App are indicative and may change.

• The app store processes all payments. All purchases are made through, and charged to, your Apple account (App Store) or Google account (Google Play), under that store's terms. We do not receive or store your payment details. The App receives only a confirmation that a purchase completed and then grants the item on your device.
• Kazcade Plus subscription. Kazcade Plus is an auto-renewable subscription (offered monthly and annually) that removes ads and grants member perks while active. It renews automatically for the same price and period unless you turn off auto-renew at least 24 hours before the end of the current period. Manage or cancel it any time in Apple ID → Subscriptions (iOS) or Google Play → Subscriptions (Android). If a subscription ends, member benefits stop and ads resume; items already granted on your device remain.
• Delivery & restore. Purchased virtual items and entitlements are granted to the copy of the App on your device. Non-consumable purchases and an active subscription can be re-granted using the store's Restore Purchases function on a device signed in to the same Apple or Google account.
• One-time / new-player offers. Certain offers (e.g. the Starter Pack) are available only once and/or only to new players below a certain progress point, and may become unavailable afterward.
• Authorization. You are responsible for all purchases made through your Apple or Google account, including by minors using your device. Manage purchase restrictions in your device settings (e.g. Screen Time / Content & Privacy Restrictions on iOS, or Google Play parental controls / purchase authentication on Android).

5.1 Refunds

Because the app store is the merchant of record, refunds are handled by Apple or Google under their policies, not by us. Request a refund from Apple at https://reportaproblem.apple.com or from Google at https://play.google.com/store/account. Except where required by law, all purchases are final. We are unable to directly refund, reverse, or credit store transactions.

6. Virtual items and virtual currency

The App includes virtual currency ("coins" and "gems"), virtual credits (e.g. undo credits), cosmetics, and other virtual items (collectively, "Virtual Items"). You should understand and agree that:

• No real-world value. Virtual Items have no monetary value, are not real currency, and cannot be redeemed for cash or exchanged for anything of monetary value from us.
• License only. You do not "own" Virtual Items; you receive a limited, personal, revocable license to use them within the App under these Terms. We may manage, regulate, control, modify, or eliminate Virtual Items at any time, with or without notice, subject to applicable law.
• Non-transferable / non-tradeable. Virtual Items are non-transferable and non-tradeable except through features (if any) we expressly provide within the App, and may not be sold, gifted, or transferred outside the App or between accounts, devices, or platforms except as the App itself allows.
• Non-refundable. Except as required by law or handled by Apple or Google under Section 5.1, purchases of Virtual Items are final and non-refundable.
• No transfer on termination. Any Virtual Items associated with your device are forfeited if your license terminates or the App is discontinued, and are lost if you delete the App (see Sections 7 and 11).
• Earned vs. purchased. Some Virtual Items can be earned through gameplay or by watching rewarded ads, and some can be purchased. In all cases the terms of this Section apply.

7. Your device data; no accounts; no cloud save

The App does not use accounts and stores your progress, Virtual Items, settings, and any optional in-game name only on your device. We do not operate a server that stores or backs up your game data.

This means: if you delete the App, change devices, or lose your device, your game progress and any unused earned Virtual Items may be permanently lost. Non-consumable purchases and an active subscription can generally be restored through Apple or Google (Section 5). We are not responsible for lost progress or lost earned Virtual Items, and we have no ability to recover on-device data remotely.

8. Updates and changes to the App

We may update, modify, suspend, or discontinue the App or any feature (including gameplay, the economy, ad behavior, or Virtual Items) at any time, with or without notice, subject to applicable law. We are not obligated to provide updates, maintenance, or support. Continued use after an update constitutes acceptance of the change.

9. Disclaimers ("as is")

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ALL CONTENT AND VIRTUAL ITEMS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components, or that defects will be corrected. You use the App at your own risk.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL NO FREE LUNCH OR ITS OWNERS, OFFICERS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, PROGRESS, OR VIRTUAL ITEMS, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE APP AND THESE TERMS WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID (VIA APPLE OR GOOGLE FOR KAZCADE IN-APP PURCHASES) IN THE 12 MONTHS BEFORE THE CLAIM.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

11. Termination

These Terms apply until terminated. Your license terminates automatically if you fail to comply with them. We may suspend or terminate your access to the App at any time if you violate these Terms (including Section 3) or as required by law. You may terminate at any time by ceasing use and deleting the App.

On termination: your license ends, you must stop using the App and delete it, and any Virtual Items are forfeited without refund (except as required by law or handled by Apple or Google). Sections that by their nature should survive termination (including Sections 2, 6, 9, 10, 12, and 14) will survive.

12. Governing law and disputes

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-laws rules. You and we submit to the courts located in Alberta for any dispute not otherwise required to be brought elsewhere by mandatory law.

Nothing in this Section deprives you of the protection of mandatory consumer-protection provisions of the law of the country in which you reside.

13. Store-specific terms

You acknowledge and agree that these Terms are between you and No Free Lunch only — not with Apple or Google — and that the store from which you obtained the App is not responsible for the App or its content.

13.1 Apple (App Store)

To the extent required by Apple, for the App obtained through the App Store:

• Apple has no obligation to furnish any maintenance or support for the App.
• In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) you paid for the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are our responsibility, not Apple's.
• Apple is not responsible for addressing any claims by you or a third party relating to the App or your use of it, including product-liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims under consumer-protection or similar law.
• In the event of a third-party claim that the App or your use of it infringes that third party's intellectual-property rights, we (not Apple) are responsible for the investigation, defense, settlement, and discharge of that claim to the extent required by these Terms.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

13.2 Google (Google Play)

For the App obtained through Google Play, the Google Play Terms of Service also apply to your acquisition and use of the App. Google is not a party to these Terms and is not responsible for the App or for addressing any claims relating to it. Where these Terms conflict with the Google Play Terms of Service as to the App obtained through Google Play, the Google Play Terms of Service control for that subject matter. Support, warranty, and refund handling for the Google Play version are as described in Sections 5, 5.1, and 8.

14. General

• Entire agreement. These Terms and the Privacy Policy, together with Apple's or Google's applicable store terms, are the entire agreement between you and us regarding the App and supersede prior agreements on that subject.
• Changes to these Terms. We may update these Terms from time to time. We will revise the "Last updated" date and post the current version at https://kazcade.app/terms. Material changes may be highlighted in the App or store listing. Continued use after changes take effect constitutes acceptance.
• Severability. If any provision is held unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be modified to the minimum extent necessary to be enforceable.
• No waiver. Our failure to enforce any provision is not a waiver of it.
• Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
